Siteopia provides Domain Name, Internet, Email, SiteBuilder and SEO services. Siteopia reserves the right to refuse, suspend or cancel registration or access to any or all services provided by Siteopia at any time deemed necessary.

General Terms and Conditions

These Terms and Conditions form the agreement between us, Siteopia and you the customer and governs the use of any brand or website within the Ventutec group.

1. Definitions

   • 1.1'we', 'us' and 'our' refers collectively to Ventutec Limited (company Number 05777893), registered office at Independence House, Queen Street, Worcester, WR1 2PL and any of the groups brands including specifically Siteopia.com

   • 1.2'Siteopia' refers to the brand Siteopia and use of the website www.Siteopia.com

   • 1.3'Agreement' refers to any agreement to which these Terms and Conditions are incorporated.

   • 1.4'Package' refers to a collection of services

   • 1.5'Service' or 'Services' refers to the service or product supplied by Siteopia.com

   • 1.6'You' or 'Your' refers to the customer, the purchaser of any services or products from Ventutec Ltd and any associated brand of the company.

   • 1.8'Control Panel' refers to the Siteopia Customer area where you manage your data and services at cp.Siteopia.com

   • 1.8This agreement will remain in force for the duration of your service contract length, including any renewal periods.

2. Website Access and Usage

   • 2.1You will be able to access the majority of www.Siteopia.com without having to register any details with us. However, particular areas of the site will be accessible only if you have registered. In order to access the Siteopia Control Panel, registration is essential.

Services Provided By Siteopia

1. All Services

   The following Terms and Conditions apply to all services provided by Siteopia.com.

   • 1.1Siteopia reserves the right at any time to change the supplier of any of our products and services, including any registrars with whom we manage your domain name. If such a change requires us to act on your behalf to perform a registrar transfer, you grant us authorisation to do so. By performing any necessary transfers you also accept that following the transfer you will be unable to transfer your domain to another provider for a period of 60 days.

   • 1.2All of our products and services require advance payment for registration and renewal. You understand that without payment we are unable to supply services.

   • 1.3You acknowledge that the registration price for any service listed on Siteopia.com may be subject to change at any time without notice. You also acknowledge that renewal prices may vary to initial registration prices and that you are responsible for any increases or extra charges that may be applicable throughout your continued use for our services. Such renewal fees and any associated changes in price are applicable until your contract ends. The termination of a service does not automatically end your contract with Siteopia.

   • 1.4Upon purchase you will select an initial contract term, generally covering periods of, but not limited to 1 month, 1 year or 2 years. Any renewals due will be based upon the same period. You are able to change or amend your contract period from within your Control Panel. If for any reason the change to your renewal period is made by Siteopia, we will inform you of the change.

   • 1.5You agree and acknowledge that your services are automatically set to auto-renewal as default once you have made your purchase. This means that where a stored payment card is held Siteopia, we will collect the payment required to renew the product or service at the end of the contract period. You are able to amend your renewal preferences from within your Control Panel at any time and this is the sole responsibility of the customer to do so. This applies to any services where a renewal period is selected.

   • 1.6Failure to have a valid stored payment card on your account may result in the permanent loss of your services. Siteopia does not accept liability for any loss of service due to this.

   • 1.7At any time we are able to refuse an order. If we should refuse an order we will notify you that your order has not been processed. In the even that we cancel an order for services you have submitted payment for, at the point of purchase, we will issue a refund.

   • 1.8As soon as your order is accepted your purchase request will be submitted for processing. Therefore by entering into these Terms and Conditions you agree too and acknowledge that you will not be able to exercise any right you may have under distance selling regulations.

Terms and Conditions Relating to Domain Names

1. Domain Registration

   • 1.1Your domain name order can be placed via the website or through one of our representatives. You must fully indicate the domain name that you wish to register and provide full, complete and accurate details of the domain registrant. Where required you will provide any information deemed necessary for the domain extension that you wish to register. Siteopia will not be held liable for any information that you are unable or fail to provide.

   • 1.2Siteopia will endeavour to register any domain names as specified by you during the order process. We will show availability of domains at the time of searching. We can not guarantee the registration or availability periods of any domain search's and can not be held liable for any losses due to non — availability reasons.

   • 1.3Siteopia provides domain names and is governed by the domain extensions respective naming authority. You agree to abide by the rules by each authority for any domains in your ownership. You also agree to abide by the Terms and Conditions of any domain registrar used by Siteopia for the provision of certain domain name extensions.    • 1.4You agree to provide all requested information that forms part of your domain name registration and Siteopia account creation. It is your responsibility to ensure that any information given is accurate and updated.

   • 1.5When registering an applicable domain name should you want to protect your contact details from the WHOIS database you should indicate this at the time of purchase. At a later stage you may add domain privacy from within your Control Panel. Businesses may opt out of displaying details on applicable domain extensions by offering an alternative addresses.

   • 1.6At various times we may offer pre-ordering services for domain names. At this time we will endeavour to obtain the domain name as specified by you. Siteopia can not be held responsible or liable for any domains not captured.

   • 1.7Siteopia can not guarantee the registration of any domain names and shall not be held liable should the situation arise and the domain is not captured. We show live domain results at the time of searching, if in the event that the domain is registered following search and completion of order, Siteopia are not liable for any loss of names.

   • 1.8The success or failure of any domain registration is influenced by factors that may be beyond our direct control. We offer our services on an 'available' basis. The successful registration of your domain name is dependant on the acceptance of the applicable domain registry or registrar.

   • 1.9Siteopia will not be liable for any decision made by the registrar/registry for the refusal of a registration. In the instance that you have paid Siteopia for the domain and the registration is refused we will issue a refund for the intended service(s).

   • 1.10It is the responsibility of the customer to request a refund.

   • 1.11Siteopia will not by held liable for any fees, refunds or losses made after registration if you should be required to relinquish control of your domain or cancel your order. If you choose to or are required to release your domain name during the registration period, no refunds will be given.

   • 1.12You agree to provide registrar details for your domain names at the time of purchase. These details will be used as the legal owner of the domain name. These same details will also be used as any technical and administrative contact for your domain.

2. Domain Name Fees

   • 2.1You agree to pay Siteopia prior to the application for registration of the domain name any amounts that relate to the registration and associated services for your chosen domain name.

   • 2.2In the event of a chargeback issued by a credit card company you agree that the domain name shall be transferable to Siteopia. In the event that you may wish to reinstate your domain name you agree to the payment of £10 to cover transfer costs.

   • 2.3Should you take advantage of any free domain offers, you accept that you will be charged for the renewal of the domain name.

   • 2.4You are entitled to request the cancellation of any domain name order provided that we have not yet started processing your registration request. If processing has begun you are liable for all fees associated with the application.

   • 2.5All authorised refunds will be returned to the original payment method.

   • 2.6Where you have processed an order for any domain name requiring additional information for registration and for any reason you are unable to provide information, you shall be liable for full registration charges.

   • 2.7For international domain cancellation you may be required to complete additional forms. It is your responsibility to do so. Failure to complete and return forms resulting in any charges will be fully payable by you the customer. The domain may not be cancelled due to non-receipt of such forms for which Siteopia shall carry no liability.

   • 2.8For any renewals due, Siteopia require payment in advance.

3. Domain Name Renewals

   • 3.1Siteopia operates an automated renewal system. You will be notified on your nominated email address at least 7 days before your renewal is due. Siteopia will notify you up to the day of the domain expiry. It is your responsibility to pay for your renewal in due course and ensure that the registration of your domain name was successful.

   • 3.2It is the sole responsibility of the customer to ensure that their domain names are renewed.

   • 3.3Should a domain name expire, any associated services may also not longer be assessable. Siteopia has no liability for losses in this instance.

   • 3.4Renewal schedules do differ for different extensions. It is the responsibility of the customer to familiarise themselves of such processes. As the domain supplier Siteopia will notify the customer of any renewals due in line with the relevant processes for domain extensions on your account.

   • 3.5If auto-renewal is selected Siteopia will renew your domain names using your stored payment card.

   • 3.6Once a renewal period has lapsed without payment being received, the customer accepts that they have no right over the domain name.

   • 3.7You agree to the information provided on your account be used to received renewal notifications. You are unable to unsubscribe from such reminders from within your Control Panel.

4. Domain Dispute Policy

   • 4.1You agree that the domain name(s) requested for registration or any domain name used in conjunction with any services provided by Siteopia shall not infringe on third party rights or intellectual property rights.

   • 4.2You acknowledge that should any domain disputes arise, Siteopia must act under the instruction of the customer and therefore you shall resolve any disputes in accordance with the respective domain name authority. 5. Domain Name Transfers

   • 5.1You may request to transfer your domain name to an alternative provider at any time via your online Control Panel. Siteopia agrees to unlock domains following a request. For GTLD domain names, upon the request of a tag code, we agree to send this to the contact email provided on your account. For .uk domains Siteopia will unlock your domain for 60 days, if after this time your new provider has not initiated the transfer Siteopia will re-lock your domain name.

   • 5.2We will not be held responsible for any delay or errors during the transfer process.

   • 5.3Where you wish to transfer a domain to Siteopia, it is the responsibility of the customer to hold an account with us. Any transfer into Siteopia is an acceptance of our Terms and Conditions.

Terms and Conditions Relating To EMAIL SERVICES

The following Terms and Conditions apply to Email services.

1. Email Services

   • 1.1Email packages provided by Siteopia can be found at www.Siteopia.com/email

   • 1.2You agree to administer your email package(s) via your Control Panel.

   • 1.3In the event that you should require additional features you agree to upgrade to the next suitable package.

   • 1.4Each Siteopia email package is assigned a storage quota. With the purchase of any email package you agree to abide by the storage limits set for your chosen package. Storage limits are in place to protect your account from potentially large volumes of email sent to any one address that could potentially affect the operation of your email package and/or the email server. It is your responsibility to manage your own email account including monitoring of storage levels. Siteopia will not be held liable for any lost mail.

   • 1.5Siteopia takes all necessary steps to ensure that mailboxes are secure and that data integrity is upheld at all times. On any occasion where there may be a problem with any mailboxes it is your responsibility to inform us of any occurrence.

   • 1.6In the event of any loss of information Siteopia holds no responsibility and cannot guarantee to restore data. Siteopia will not be held liable for any losses.

   • 1.7Anti-Virus comes as standard with all Siteopia email plans. Our Anti-Virus software is configured to check messages entering the server. If for any reason you inherit a virus, Siteopia will not be held liable for any loss associated with such an occurrence. It is your responsibility to protect yourself from Viruses.

   • 1.8Spam filtering can be configured on every Siteopia email plan. You are able to set your own level of spam filtering from within your Control Panel. Siteopia reserves the right to mark any email as Spam if caught by our systems. To ensure any unintended emails get marked as Spam, it is your responsibility to manage both your personal whitelist and blacklist from within your Control Panel.

   • 1.9In the event that any particular mailboxes are causing problems to the Siteopia systems, Siteopia reserves the right to remove them in order to resolve the problem.

   • 1.10With BusinessMail, users can assign multiple domain names to the package. The maximum number of domains that any one email package may be applied to is 10. Storage allocations are referenced related to the entire package and can be allocated across each domain from within your Control Panel. You also agree to adhere to any limits or quotas set for assigning mailboxes to each domain name. At any time for un-used mailboxes Siteopia reserves the right to amend such limits.

   • 1.11Should you cancel your email service you are responsible for uninstalling any software that is licensed to you as part of the service.

Terms and Conditions Relating To SITEBUILDER

The following Terms and Conditions apply to SiteBuilder service.

1. SiteBuilder

   • 1.1SiteBuilder is a product sold by Siteopia.com and refers to SiteMaker, provided by SiteMaker Software Limited (the 'company'), which provides its services to you. The Terms and Conditions of the company and those made by Siteopia may be updated from time to time with no notice to you.

   • 1.2We recommend that any minors using SiteBuilder consult with their parents/guardians regarding these Terms and Conditions

   • 1.3By purchasing a SiteBuilder product from Siteopia you also agree to accept all Terms and Conditions as set out by SiteMaker Software Limited. This includes any new updates or releases that the company should make from time to time.

   • 1.4SiteBuilder contains images, artwork and widgets that are given on a licence basis from their owners. You are not permitted to download or use material from SiteBuilder for any purposes outside the use of the product itself.

   • 1.5Your SiteBuilder site is hosted by SiteMaker Software Limited and due to the nature of their database driven technology it is not possible to copy your SiteBuilder website. If the company cannot for any reason continue to host your website, you will lose it. You agree by acceptance that you are unable to hold the company or Siteopia liable and the company accepts no liability for any loss of data relating to your site. Siteopia strongly advises that you keep copies of any data, images or otherwise that you upload when building your website.

2. Description of Service

   • 2.1Descriptions of all SiteBuilder packages offered by Siteopia can be found on SiteBuilder Packages

   • 2.2When a template is selected for your website you agree that in order to change it you must create a new package. We recommend that you select a package to suit your needs on initial sign up.

   • 2.3Support is provided by online support guides and creating Enquiries submitted through your Control Panel.

   • 2.4To activate or edit your SiteBuilder you agree to follow all instructions as laid out by Siteopia, including logging in to your Siteopia Control Panel.

   • 2.5Your SiteBuilder 14 day free trial is valid for 14 days only from the date of sign-up. Siteopia cannot be held liable for any information you upload to your trail site and unless upgraded your site will be deleted following the trial. To start a trial you agree to creating an account with Siteopia and you accept the associated Terms and Conditions of the free trial.

   • 2.6You agree to provide accurate and up-to date information when signing up to SiteBuilder.

   • 2.7You agree that the email address you provide for creating an account can be used for email purposes by Siteopia. Any personal date you provide will be governed by our Terms and Conditions regarding the handling of personal information.

   • 2.8SiteBuilder products require the registration of a domain name or the use of a sub domain which you agree to provide.

   • 2.9SiteBuilder purchases, upgrades and renewals require payment in advance.

   • 2.10Failure to pay a renewal fee may result in your SiteBuilder being frozen and taken off-line. To re-activate your service you may be able to do so via your Control Panel. If after 7 days we still have not received payment we can delete your site and will deem this to be a termination of your service If a site is deleted Siteopia will not be liable for any losses.

   • 2.11You may cancel your SiteBuilder service by giving us 30 days written notice, either by letter or ticket sent via your Control Panel. If you cancel your service, your site and its contents will be deleted. We will not provide refunds of part payments of any kind if you decide to cancel your service before the contract end date. Please note that deleting your site does not cancel your subscription, to do this you must submit cancellation via writing.

   • 2.12You agree to pay any funds for failure to correctly cancel your services. Siteopia and SiteMaker Software Limited will not be liable for additional costs.

   • 2.13Siteopia shall not be liable for any additional costs that you encounter through the use of SiteBuilder.

   • 2.14Siteopia has the sole discretion to freeze or delete a site at any time deemed necessary for breach of these Terms and Conditions or for unlawful activities.

   • 2.15You agree not to use SiteMaker for any unlawful, defamatory, harmful or invasive purposes and accept that you may not upload, post or transmit any content for which you do not have consent to use.

Terms and Conditions Relating To SEARCH ENGINE OPTIMISATION

The following Terms and Conditions apply to SEO Services.

1. General Terms

   • 1.1Before any of our SEO services can be completed and returned to you, payment must be received.

   • 1.2After receipt of payment, any refunds given are at the sole discretion of Siteopia.

   • 1.3You agree to provide all necessary information to enable us to conduct your SEO report. Failure to provide information may result in us being unable to send you your report. You also acknowledge that if payment is made for a service and you are then un-able to provide the necessary keyword and URL information that no refund shall be given.

   • 1.4You are required to create a Siteopia account where you will need to provide personal information. Handling of this information will be governed by our Privacy Policy

   • 1.5Siteopia does not guarantee any specific SEO improvements or results and can only offer guidance and suggestions for any SEO techniques or principals relating to your website. Under no circumstances can we be held liable for your websites' SEO performance.

   • 1.6You agree that you are solely responsible for carrying out any prescribed actions that the report identifies. Siteopia is not required to carry out any of the SEO recommendations on your behalf. This service is provided on a report basis only.

   • 1.7To enable us to generate your SEO report, it is necessary to enter your URL and keywords to third party web sites. Through the payment of this service, you acknowledge your consent for us to do this.

   • 1.8Reports shall be sent to the email address provided in your Control Panel. You are able to change your default email address from within your Control Panel at any time. It is your responsibility to keep your details up to date.

   • 1.9With the purchase of a Competitor Review report, Siteopia does not guarantee any results. Siteopia provides information to the best of its ability but cannot guarantee the accuracy of information or be held liable for any such errors or forthcomings.

CONTROLLING YOUR PERSONAL INFORMATION

You may request details of personal information which we hold about you under the Data Protection Act 1998. A small fee of £10 will be payable. If you would like a copy of the information held on you please write to Ventutec Limited, Independence House, Queen Street, Worcester, WR1 2LR with a cheque made payable to Ventutec Limited.

If you believe that any information we are holding on you is incorrect or incomplete, please email support@siteopia.com or submit an Enquiry through your Control Panel. We will promptly correct any information found to be incorrect.

Please be aware that information and personal data carried over the Internet and by e-mail is not secure and is liable to interception, loss, redirection and corruption by other people unless it is encrypted by you, this is not the responsibility of Ventutec Limited and we are not liable for any such interception.

Terms and Conditions Relating To DOMAIN PRIVACY

1. • 1.1 By purchasing Domain Privacy you actively agree that your personal data, visible on the WHOIS register, shall be replaced with Siteopia's Domain Privacy contact details.

   • 1.2 The following information will instead be visible on the WHOIS register against your domain name:

2. 1.3 Please note that your personal email address will be replaced on the WHOIS register with Siteopia's Domain Privacy email address prepended with a (uniquenumber) used to identify your domain name.

3. 1.4 Domain Privacy is available on selected domain extensions as set out on the Domain Privacy product page.

4. 1.5 As the Domain Owner, you remain in complete control of the domain name. Your original registrant data shall remain on file with Siteopia and you are responsible for ensuring the accuracy of this information at all times.

5. 1.6 Domain Privacy is available for both new and existing domain names and it is your responsibility to request and pay for the service, at the point of check-out or from within your online Control Panel.

6. 1.7 Domain Privacy is offered for the same period as the registration period of your domain name.

7. 1.8 Renewal notifications will be issued at the time of expiry to the email address supplied in your Control Panel.

8. 1.9 Any postal communications received shall be forwarded to the email or postal address provided on your account.

9. 1.10 Siteopia cannot be held liable for any communications not received or forwarded.

10. 1.11 In the event that we may be required by law to supply legal registrant information, we may do so at our sole discretion.
